MindGov.com is an independent commentary and analysis blog committed to respecting intellectual property rights under U.S. and international law, including the Digital Millennium Copyright Act (DMCA), the Berne Convention, and equivalent frameworks. This Copyright Policy outlines our approach to third-party content, user submissions, and infringement reporting. Your use of the Site is governed by our Terms of Use.

1. Our Use of Third-Party Content Our content primarily consists of original commentary and analysis on governance and policy issues. Where we embed publicly available third-party materials (e.g., videos from YouTube or other platforms):

  • Such embeddings are included solely for purposes of criticism, commentary, news reporting, research, and informational analysis.
  • In the United States, this use is intended to align with fair use provisions under Section 107 of the U.S. Copyright Act (17 U.S.C. §107), considering factors such as the nonprofit/commentary purpose, the transformative nature of our added analysis, the limited amount used (only as necessary for context), and no substitution for or harm to the market for the original work.
  • Internationally, we rely on equivalent exceptions, including:
    • Fair dealing in jurisdictions such as the UK, Canada, and Australia (for criticism, review, research, or study);
    • Permitted acts under EU directives (e.g., quotation, criticism, or review under Directive 2019/790); and
    • The Berne Convention's three-step test (confined to special cases, no conflict with normal exploitation of the work, and no unreasonable prejudice to the legitimate interests of the rights holder).

Embeddings stream directly from the original source platforms (e.g., via official YouTube embed codes); no content is hosted, downloaded, reproduced, altered, or stored on our servers. We add substantial original transformative commentary to provide context and analysis. We do not claim ownership of any third-party materials, all rights remain with their respective owners.

2. User-Generated Content If you submit content to the Site (e.g., comments or other contributions):

  • You represent and warrant that your submissions do not infringe any third-party copyrights, trademarks, or other intellectual property rights.
  • You grant us a worldwide, royalty-free license to use, display, and moderate your content in connection with the Site.
  • You agree to indemnify us against any claims arising from infringements in your submissions. We reserve the right to remove any user content that may infringe rights.

3. Reporting Copyright Infringements We respond promptly to claims of copyright infringement. If you believe your work has been used in a way that constitutes infringement:

DMCA Takedown Notices (U.S. Claims) To file a notice under the DMCA, provide the following information in writing to our Designated Agent:

  1. A physical or electronic signature of the copyright owner or authorized agent;
  2. Identification of the copyrighted work claimed to be infringed;
  3. Identification of the material claimed to be infringing (including URL(s) for precise location);
  4. Your contact information (address, telephone number, email);
  5. A statement that you have a good-faith belief the use is not authorized by the owner, agent, or law;
  6. A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the owner.

Upon receipt of a valid notice, we will expeditiously remove or disable access to the allegedly infringing material and notify the affected user (if applicable).

Counter-Notices If material is removed and you believe it was wrongful, you may submit a counter-notice containing:

  1. Your physical or electronic signature;
  2. Identification of the removed material and its prior location;
  3. A statement, under penalty of perjury, that you have a good-faith belief the removal was mistaken;
  4. Your name, address, phone number, and consent to jurisdiction in U.S. federal court (or equivalent if outside U.S.);
  5. Agreement to accept service of process from the complainant.

We will forward counter-notices to the complainant and may restore material if no lawsuit is filed within 10-14 business days.

International and Non-DMCA Claims For claims under other jurisdictions (e.g., EU e-Commerce Directive notices), provide equivalent details to the contact above. We will review and respond in accordance with applicable laws.

4. Repeat Infringers We may terminate access for users who are repeat infringers.

5. Disclaimers and Limitations of Liability The Site and its services are provided "as is" without warranties. To the maximum extent permitted by law, in no event shall our total liability to you for all damages, losses, or causes of action exceed $1 (one U.S. dollar).

For EU/UK users and under applicable law, nothing in this Policy limits or excludes liability for gross negligence, willful misconduct, death/personal injury, fraud, statutory copyright remedies, or other liabilities that cannot be limited by law.
